What are the types of Lasting Power of Attorney?

There are two types of Lasting Power of Attorney:

Health and welfare decisions

A health and welfare Lasting Power of Attorney gives people the power to make decisions about things like:

  • your daily routine – for example, washing, dressing and eating
  • speaking to your doctor on the behalf of you
  • medical care
  • moving into a care home
  • life-sustaining treatment

You apply and register it now, but it’s only used if you can’t make your own decisions in the future.

Financial decisions

A finance and property Lasting Power of Attorney gives someone you trust the power to make decisions about your money and property, for example:

  • paying bills
  • managing a bank or building society account
  • collecting benefits or a pension
  • selling your home

These powers can be used at any time, but only if you say it’s ok.

We highly recommend you choose both types available. It is important you seek legal advice whilst you prepare these documents as this can cause problems if you have not set it up correctly in the future.

Our advisors here at Future Wills often get asked, do we need both types of Lasting Power of attorney?

The answer is yes, of course! Is there any point in being able to only pay of care home fees but have no decision of where you’d like to place the individual? This is just one example. You can seek for more information from us, if you’d like to find out more.
